Crescendo provides marketing and communication services for local businesses, including missed-call text-back, AI-assisted answering and web chat, appointment scheduling, follow-up messaging, and related tools ("Services"). Specific plan features, pricing, and any service guarantees are described on our website at the time of purchase and in your service agreement, which together with these Terms form the agreement between us.
Accounts and acceptable use
- You must provide accurate business information and keep your contact details current.
- You may not use the Services to send unlawful, deceptive, or unsolicited messages, or any content that violates applicable law, including the TCPA and CTIA messaging guidelines.
- You are responsible for obtaining any consents required to message your own customers, and for honoring opt-outs.
- We may suspend Services that are being used in a way that threatens the integrity of our platform or violates carrier rules.
Messaging terms
Text messages sent through our platform include opt-out instructions. Message frequency varies and message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to receive messages is not a condition of purchase.
Billing
Paid plans bill monthly in advance to your payment method on file and continue until canceled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Any money-back guarantee we advertise is honored exactly as described on the page where you purchased.
Intellectual property
The site, our software, and our content are owned by Crescendo or its licensors. Your business information, customer lists, and conversations remain yours; you grant us the limited rights needed to operate the Services for you, and you can export your data at any time.
Disclaimers
Except as expressly stated in a written guarantee, the Services are provided "as is." We do not guarantee specific business results, and we are not responsible for failures of telecommunications carriers, third-party platforms, or your own systems.
Limitation of liability
To the maximum extent permitted by law, Crescendo's total liability for any claim arising out of the Services is limited to the amounts you paid us for the Services in the three (3) months before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.
Governing law
These Terms are governed by the laws of the State of Texas. Any dispute will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.
Changes
We may update these Terms from time to time. Continued use of the site or Services after changes are posted constitutes acceptance. The current version will always be available on this page.
